			<content:encoded><![CDATA[<p>New legislation was passed for the State of Jalisco on July 30, 2011, pertaining to &#8216;guardianship&#8217;.  While the topic of guardianship is beyond the scope of the Life Planning in Jalisco publication and website, some reference is made to the topic and the legislation because a limited &#8216;durable power of attorney&#8217; and the ability to create limited health directives came with the new legislation.</p>
<p style="padding-left:30px;">Note: <em>a US durable power of attorney designates someone to act on your behalf when you cannot act on your own because you cannot speak for yourself in any way and it remains valid through incompetency.   The document is not designating in &#8216;advance&#8217; a &#8216;guardian&#8217; who has responsibilities well beyond someone given authority to act on your behalf.</em></p>
<p>The new State of Jalisco durable power of attorney remains in place beyond mental incapacitation and does not expire.  It was intended to identify in advance a &#8216;guardian&#8217; should the maker ever use the guardianship process.  The durable power of attorney could then be used under the guardianship&#8217;s supervision.  To be determined is how broadly the durable power of attorney will be interpreted.</p>
<p>The health care directives are intended to be for &#8216;therapeutic (curative) treatments specifically&#8217; (unlike the MX federal legislation which provides patient&#8217;s rights to palliative and end-of-life care when terminal and in the last 6 months of life).  To be determined is how broadly the health care directives will be interpreted.</p>
<p>Although I have a copy of the legislation, I don&#8217;t yet have an on-line source. When I get that information, I will post it here.</p>

<h3><span class="Apple-style-span" style="font-size:12px;line-height:18px;color:#444444;">Saturday, November 29 2008 09:37 GR Staff   </span><span class="Apple-style-span" style="font-size:16px;color:#444444;line-height:24px;">MEXICO &#8211; After a two-year debate, the Mexican Senate has passed a law obliging doctors to obey the wishes of  patients with incurable diseases who want to have life-prolonging treatments suspended.</span></h3>

<p>Patients and their families will now be allowed to check themselves out of hospital and die with dignity in their own homes, said Party of the Democratic Revolution (PRD) legislator Lazaro Mazon, one of the authors of the bill.</p>
<p>The Senate passed the bill back in June but the lower house insisted that only patients with a life expectancy of less than six months should be allowed to suspend their treatments.</p>
<p>The Senate voted unanimously in favor of the law, with only one abstention.</p>
<p>Under the law, doctors are still obliged to provide patients with pain killing medicines and psychological help.</p>
<p>National Action Party (PAN) legislator Ernesto Saro Boardman, president of the Senate health committee, said the measure made economic sense as doctors often push expensive treatments on patients, despite knowing full well that their condition is incurable.</p>
<p>Saro said the law would also “free up equipment” in hospitals. She cited the case of a young man admitted to hospital with a collapsed lung being unable to be put on a respirator because none were available. He subsequently died and it was later discovered that several respirators were being used by elderly patients in their final stages of life.</p>
<p>Patients and their families who wish to end life-prolonging treatment will have to make their request to doctors in writing and can rescind their decision at any time.</p>
<p>Legislators decided not use the term passive euthanasia in the final bill, so as not to “scare” people, said Mazon.</p>
<p>Contrary to many other western nations, polls in Mexico suggest a majority of citizens are opposed to the idea of assisted suicide, or allowing a doctor or other person to administer a lethal agent to a dying person.</p>
<p>The Catholic Church has given its approval of the law but remains strongly opposed to any form of voluntary euthanasia.</p>
<p>According to several sources, certain forms of euthanasia are legal in Switzerland, Belgium, Luxembourg, the Netherlands, and the U.S. states of Oregon and Washington.</p>

<p align="center"><strong><em> and Health Care Directives”</em></strong></p>
<p>This <em><span style="text-decoration:underline;">Designation of Person(s) for Medical Decisions and Health Care Directives</span> </em>is written in accordance with the Mexican Legislative <a title="Legislation in Spanish and English" href="http://www.rollybrook.com/life_care_law.htm">Decree Reforming and Adding to the General Health Law of Palliative Care</a> (DOF 05 January 2009), Chapter II, Paragraph X, Article 166 Bis 5.  Bis 4 provides that this document can be revoked at any time.</p>
<p><strong>Person(s) authorized </strong><strong>to make Medical Decisions</strong></p>
<p>I, <span style="text-decoration:underline;">XXX</span>, authorize xxxxxx to make medical decisions on my behalf if I am unable to speak for myself in any way.  In the event that xxxxx is unable or unwilling, I designate xxxxxx, then xxxxx, then xxxxx, and then xxxxx, in this order.</p>
<p><strong>Health Care Directives</strong></p>
<p>The following are my directives if I cannot speak or communicate in any way. I write this in an alert state and mentally capable of making these decisions.</p>
<p>If the medical doctor who is in charge of caring for me states that my condition is terminal and irreversible, that I’m in a permanent vegetative state, or that I am in a coma with no reasonable belief this will change <em>and</em> that I’m expected to live less than six (6) months, follow these health care directives <strong><em>(<span style="text-decoration:underline;">follow the legislation</span>):</em></strong></p>
<p>I <strong>DO WANT</strong> <strong><em>(FOR EXAMPLE)</em></strong> hospice care (Art. 166 Bis 9).</p>
<p>I <strong>DO WANT <em>(FOR EXAMPLE)</em></strong> treatment measures my physician believes will keep me comfortable and relieve pain though this may shorten my remaining life (Art. 166 Bis 16).</p>
<p><strong>I DO NOT WANT <em> (FOR EXAMPLE) </em></strong>any life-sustaining treatments. This includes breathing and kidney machines, heart medications, blood transfusions, heart lung resuscitation, or administration of fluids and nutrition in any manner.</p>
<p><strong>I DO NOT WANT <em>(FOR EXAMPLE)</em> </strong>any invasive diagnostic tests or procedures after my diagnosis.</p>

<p><strong>The publication Life Planning in Jalisco, Part III, gives information on what to include in &#8216;Your&#8217; <em>Emergency Information Binder, </em>for example, </strong><span style="color:#ff0000;">a copy of your wallet contents.</span></p>

<p><strong>Copy the front and back of everything in your wallet such as your driver&#8217;s license, credit cards, ATM cards, etc.  </strong></p>
<h3></h3>
<p><strong>Keep the copies in the same section of your binder as your <em>emergency contact information</em> so that you have a back-up copy if your wallet is stolen or lost.   The back sides of your cards will have the contact numbers to report the stolen or lost cards.</strong></p>
<h3></h3>
<p><span style="color:#000000;">The copy in your binder also gives access to the information if  needed by anyone on your emergency contact list.</span></p>
<h3></h3>
<p><span style="color:#000000;">An easy way to copy your wallet contents is to place the cards face down on a copy machine (or scanner),  make your copy, then flip the cards and copy the back.    Staple together the corresponding pages so that  it is easy to determine which &#8216;front&#8217; belongs to which &#8216;back&#8217;.</span></p>

<p><a href="http://www.notaria114.com/">Rafael Vargas</a>, <span style="color:#000000;">Notario 114, is a partner in a large 20-member law firm in Guadalajara.  He, along with 4 other attorneys, reviewed my questionnaire and met with me to discuss:</span></p>
<ul>
<li><span style="color:#000000;">the lack of durable powers of attorney in Jalisco;</span></li>
<li><span style="color:#000000;">durable powers of attorney using the Hague agreement;</span></li>
<li><span style="color:#000000;">durable powers of attorney from other Mexican states;</span></li>
<li><span style="color:#000000;">the &#8216;tutor/guardian&#8217; process; and</span></li>
<li><span style="color:#000000;">the Mexican federal end-of-life legislation.</span></li>
</ul>
<p><span style="color:#000000;">Of the questionnaires distributed, they provided by far the most complete responses, with supporting legal citations.</span></p>
<p><span style="color:#000000;">When we started talking about the Mexican federal end-of-life legislation, the Notario had a book in front of him from which he referenced key passages on the legislation  and mentioned there were 3 other publications available.  It was to his credit that he clearly was well-read on the topic.</span></p>
<p><span style="color:#000000;">During this meeting, the Notario and others reviewed and verified for use the &#8220;End-of-Life Health Care Designation for Medical Decisions and Health Care Directives&#8221; found in Life Planning in Jalisco based on the <a href="http://lifeplanninginjalisco.wordpress.com/2011/05/01/mexican-federal-end-of-life-legislation/"><span style="color:#000000;">Mexican federal end-of-life legislation</span></a>.  His only suggestion was to have a notario sign the document even though that was not required by the legislation.   He also confirmed that the legislation is only available for use when someone has a terminal or end-of-life diagnosis, with expected less than six (6) months to live.</span></p>
<p><span style="color:#000000;">The Notario suggested making sure that durable powers of attorney for medical decisions, especially those including health care directives, from other Mexican states or from outside of Mexico follow as much as possible the Mexican federal legislation (see Life Planning in Jalisco for more detailed suggestions and information).</span></p>
<p><span style="color:#000000;">Roberto Espinoza Vera was part of the group of attorneys with whom I met. Roberto is the son of the other Notario.  His English is good.  Others in the firm speak English to varying degrees.</span></p>

<p><span style="color:#000000;">Ana Cecilia Villanueva S. is a partner in the law firm representing, among other large clients, Puerta de Hierro Hospital in Zapopan. Initial questions were submitted through Gabriela Acosta, Medical Tourism, at Puerta de Hierro Hospital.</span></p>
<p><span style="color:#000000;">The law firm confirmed on behalf of the hospital that:</span></p>
<ul>
<li><span style="color:#000000;">durable powers of attorney from outside of Mexico (i.e., the US) are legally recognized and valid for use in Jalisco (based on the 1961 Hague Agreement, apostilled and legally translated;</span></li>
<li><span style="color:#000000;"> durable powers of attorney from other Mexican states such as Coahuila are legally recognized and valid for use in Jalisco; and </span></li>
<li><span style="color:#000000;">the Mexican federal legislation end-of-life document was recognized and valid.</span></li>
</ul>
<p><span style="color:#000000;">Senora Villanueva indicated that &#8216;signed&#8217; hard copies of the documents need to be submitted to the hospital in Spanish in order for the documents to be accepted.    She had two suggestions for the Mexican federal legislation end-of-life document, which have been incorporated into the sample document in Life Planning in Jalisco. She also confirmed that the document must be signed by two (2) witnesses, but a notario&#8217;s signature is not required based on the legislation.</span></p>
<p><span style="color:#000000;">Senora Villanueva indicated that she would be glad to assist anyone interested in obtaining a durable power of attorney from another Mexican state.  Her English is good.</span></p>
<p><strong><em><span style="color:#000000;">Raoul Rodriguez Walters</span></em> (<a href="http://mexadv.com/">www.mexadv.com</a>)</strong></p>
<p><span style="color:#000000;">Raoul is one of my <a href="http://lifeplanninginjalisco.wordpress.com/2011/05/07/key-resources-cant-live-without-them/"><span style="color:#000000;">key resources</span></a> for the project.  Raoul is an estate and financial planner, who is fully bilingual, a dual citizen of the US and Mexico,  has lived in both countries, and has clients in both countries.  Because of his estate planning practice, Raoul was already aware of much of the legal information for Mexico and the US,  or he knew where to verify what I was finding or do further research.</span></p>
<p><span style="color:#000000;">For example, when we started working together, I was aware of only 3 other Mexican states offering durable powers of attorney. Raoul did further research and found 2 additional Mexican states.</span></p>

<p><span style="color:#000000;">Sergio, along with Dr. Carlos Garcia,  did a presentation at the Lake Chapala Society (LCS) in 2005 on the topic of <a href="http://http//www.lakechapalasociety.org/test/LakeSide_FAQ/livingwillinfo.htm"><span style="color:#000000;">Living Wills and Durable Powers of Attorney</span></a>.</span></p>
<p><span style="color:#000000;">This was the first formal reference I found about obtaining durable powers of attorney from other Mexican states.  This was key since Jalisco does not offer a durable power of attorney.   At that time, only three (3) Mexican states offered &#8216;durability.&#8217;   As of 2011, there are now five (5) states and that number may be increasing overtime.</span></p>
<p><span style="color:#000000;">Sergio also reviewed the &#8220;End-of-Life Health Care Designation for Medical Decisions and Health Care Directives&#8221; verifying it followed the legislation and that the legislation was valid only for persons with a terminal condition with an expected less than six (6) months to live.</span></p>
<p><span style="color:#000000;">Sergio&#8217;s English is good.  He can do legal translations for apostilled documents.  Also, he can assist in obtaining a durable power of attorney from another Mexican state by helping you find a notario or attorney in another state.</span></p>
<p><em><span style="color:#000080;">On the link from the 2005 presentation is a list of notarios from other Mexican states.  In addition, here&#8217;s a link to <a href="http://http//www.incamex.org.mx/info_notaria-114--vargas-aceves-rafael.htmlhttp://www.incamex.org.mx/info_notaria-114--vargas-aceves-rafael.html"><span style="color:#000080;">IncaMex</span></a> which has a list of Mexican notarios and attorneys by state and practice type.  If you need English, use google through which you can get an English translation.</span></em></p>

			<content:encoded><![CDATA[<h2>Yes, there are durable powers of attorney in Mexico,<em> and as of July 30, 2011, a durable power of attorney exists in Jalisco.</em></h2>
<h4>Five (5) years ago, only <a href="http://www.lakechapalasociety.org/test/LakeSide_FAQ/livingwillinfo.htm">3 states in Mexico provided for durable powers of attorney</a>.  As of 2010, 5 states in Mexico provide for a durable power of attorney and now there are 6 states:</h4>
<ul>
<li>San Luis Potosi</li>
<li>Mexico (DF)</li>
<li>Guanajuato</li>
<li>Morelos</li>
<li>Coahuila</li>
<li><em>and Jalisco</em></li>
</ul>
<p><span style="font-size:medium;"><span class="Apple-style-span" style="font-size:16px;line-height:24px;">The first 4 states listed provide for a non-specific durable power of attorney (<a title="Interviews, References and Resources for this project!" href="http://lifeplanninginjalisco.wordpress.com/2011/08/30/interviews-references-and-resources-for-this-project/">S. Macias, Notario 5; R. Vargas, Notario 114, R. Rodriguez</a>).</span></span></p>
<p><span style="font-size:medium;"><span class="Apple-style-span" style="font-size:16px;line-height:24px;">The State of Coahuila, however, allows for designation of a durable medical power of attorney and survival of same in the event of incapacity (Macias, et al).</span></span></p>
<p style="padding-left:60px;">None of these durable powers of attorney expire.  They remain in place unless revoked by the maker.  And, they remain valid through incapacitation!</p>
<p>The durable powers of attorney are recognized in the State of Jalisco (and elsewhere in Mexico) based  the Mexican Constitution.</p>
<p style="padding-left:60px;"><em>The New legislation, effective August 1, 2011,  for Jalisco pertains mostly to improvement for legal &#8216;guardianship.&#8217;  However, with the reforms came a durable power of attorney, that remains valid through incapacitation and does not expire.  This is a &#8216;first&#8217; for Jalisco.</em></p>
<p style="padding-left:60px;"><em>Since the durable power of attorney was intended to designate in advance a person(s) who would serve as guardian (Source: R. Rodriguez), it still needs to be determined how broadly the amendment will be interpreted.   This new amendment <strong><span style="color:#993300;">may</span></strong> <span style="color:#000000;">negate the need to go to another Mexican state for a durable power of attorney to be used in Jalisco (Source: Lic Ana Villanueva).</span></em></p>
<p style="padding-left:60px;"><em>In addition, the amendments include provisions for <a title="Living Wills, Health Care Directives and more….." href="http://lifeplanninginjalisco.wordpress.com/2011/05/11/living-wills-health-care-directives-and-more/">health care directives</a>. However, the health care directives are for &#8216;<span style="color:#993300;">therapeutic [curative] treatments specifically</span>&#8216; (Source: Lic Roberto Espinosa; R. Rodriguez) unlike the <a title="Mexican Federal End-of-Life Legislation" href="http://lifeplanninginjalisco.wordpress.com/2011/05/01/mexican-federal-end-of-life-legislation/">Mexican federal</a> end-of-life legislation that provides for <span style="color:#800000;">patient&#8217;s rights to palliative and end-of-life care</span>!</em></p>

<li><strong><span style="color:#800000;">Identify several persons who can be contacted in an emergency.</span></strong></li>
<li><strong><span style="color:#800000;">Contact them and ask them to be part of your emergency contact system.</span></strong></li>
<li><strong><span style="color:#800000;">Put into print all the contact information, and note, i.e., who has the house key, etc.</span></strong></li>
<li><strong><span style="color:#800000;">Share this information via email or distribute a hard copy to everyone.</span></strong></li>
<li><strong><span style="color:#800000;">Make a wallet card that includes part or all of their names.  (Make sure to carry the wallet card.)</span></strong></li>
<li><strong><span style="color:#800000;">Make sure to load their phone numbers on your cell phone.</span></strong></li>
<li><strong><span style="color:#800000;">Make sure to post a list of all the emergency contact next to your computer or on the refrigerator, along with all of your general emergency telephone numbers such as Cruz Roja.</span></strong></li>

<li><strong><span style="color:#800000;">Make sure a few people know where to find your Emergency Information &#8216;Binder.&#8217;</span></strong></li>

<li><span class="Apple-style-span" style="color:#000000;">a wallet card (laminated) with key emergency contacts and  information, which can be kept with your<a title="Wallet contents – copy front and back of all contents" href="http://lifeplanninginjalisco.wordpress.com/2011/06/19/wallet-contents-copy-front-and-back-of-all-contents/"> credit cards</a> or cash.    Some of the information on the wallet card should be in Spanish; i.e., esposo, amiga, doctor , etc. in case a paramedic or police are trying to determine who to call, but do NOT SPEAK ENGLISH.  It should be slightly larger than your credit cards, and laminated, so that it is easily found;</span></li>
</ul>
<ul>
<li><span class="Apple-style-span" style="color:#000000;">information on your cell phone with similar key emergency contacts (<a title="Cell Phones in Emergencies" href="http://lifeplanninginjalisco.wordpress.com/2011/05/08/cell-phones-in-emergencies/">see cell phone for emergencies</a>); and</span></li>
<li><span class="Apple-style-span" style="color:#000000;">a hard copy list  of all medications, medical conditions, etc. <strong>OR</strong> a &#8216;soft copy&#8217; on a flash drive (or something similar) that stores the same information, including a photo of you to ensure the information is matched with you if you could not speak for yourself in the event of an auto accident, etc.  The hard copy can be kept in your wallet along with your &#8216;wallet card&#8217; OR the flash drive can be kept on your key ring with some ID tag indicating medical information.</span></li>
</ul>
<h3><strong><span style="color:#000000;">List of Emergency Contacts and Information</span></strong></h3>
<h3><span style="color:#000000;">Include people who have keys to your house, making sure to get keys made and distribute them to neighbors or local friends who will be listed as &#8216;having keys.&#8217;</span></h3>
<h3><span style="color:#000000;">In order to list persons who have durable powers of attorney for health or finance, you will need to have these already completed (or, in progress).</span></h3>
<h3><span style="color:#000000;">List the person&#8217;s name along with the type of POA they hold such as &#8216;health&#8217; or &#8216;finances&#8217; and make sure to note if the person(s) is NOB or here locally.  It should be a mix of persons from different locations.</span></h3>
<h3><strong>Your List of Emergency Contacts and Information should include</strong></h3>

<li><span class="Apple-style-span" style="color:#000000;font-size:22px;line-height:33px;">A list of up to 10 persons who could be contacted by you or someone else for help or assistance especially if you could not speak for yourself.  Make sure to include their name, address, telephone(S), and email, along with a message indicating &#8216;has front door key,&#8217; &#8216;has power of attorney for health, &#8216; etc.</span></li>

<li><span class="Apple-style-span" style="color:#ff6600;">WHY SO MANY PEOPLE?</span><span class="Apple-style-span" style="color:#ff6600;">Several people on the list will have different roles; i.e.  some will have keys to the house, some will have powers of attorney for health decisions or finance, some will be north and some will be in Jalisco (or Mexico).  Not only do people have different roles, but in an emergency, not all of them will be available.  Remember, people travel, people go out to dinner,  people get sick or become no longer available, etc.  . . .<span class="Apple-style-span" style="line-height:24px;font-size:16px;"> Emergencies are Not Planne</span><em><span class="Apple-style-span" style="line-height:24px;font-size:16px;">d!  </span></em></span></li>

<li><span class="Apple-style-span" style="color:#000000;font-size:19px;line-height:28px;">Why Do This?  If one person is contacted, s/he may have to contact someone else on that list to access a house key, or find someone with the durable power of attorney for health, etc. etc. </span></li>

<p><span class="Apple-style-span" style="font-size:16px;line-height:24px;"><span class="Apple-style-span" style="font-size:16px;line-height:24px;"></span></span><strong>Make sure to note on your emergency contact list that in the event of your death,  <span style="color:#ff6600;">Do Not Contact The Police</span>.    Instead have someone call your doctor noted on your Emergency Contact List, the Red Cross or funeral home noted on your <a href="http://www.lakechapalasociety.org/test/Community_Programs/PostLife/pl_05_post_life_planning.php">Lake Chapala Society (LCS) PostLife Documentation</a>.</strong></p>
